Suspended sentence for causing jogger’s death
27-year-old Kevin Ellul from Mosta was handed down a suspended jail term of three years after he ran over 59-year-old Emanuel Formosa in January 2008 in Triq Durumblat in Mosta.
Mr Ellul had been driving back home after dropping off his girlfriend in Fgura. He had drunk several alcoholic drinks that night but the court could not prove he was driving under the influence of alcohol.
Mr Formosa had suffered major head injuries and blood loss. He was wearing dark clothing, a factor that was raised in court as a potential factor. Mr Ellul was also banned from driving for one year.
Meanwhile, 46-year-old Rita Mifsud pleaded guilty to defrauding an elderly man by using his credit card to steal €43,000 from him since last March.
The woman was give a two-year jail term suspended for three years. €7,820 had already been returned to the victim but Mrs Mifsud was ordered to pay the rest within six months or face further legal action.
