On Friday Minister for Justice and Home Affairs Carm Mifsud Bonnici, said that Malta was given the assurance that the national court will not be obliged to apply divorce laws of other member states.

Other participant member of this measure states have accepted the insertion of the assurance in Article 7a of the regulation. The European Commission commented that this assurance will ensure legal certainty to couples from different countries.

The measure known as ‘enhanced cooperation’ will allow non-Maltese couples which live in Malta to obtain a legal separation from Maltese courts and apply the law of their choice.
